These Terms of Service ("Terms") govern your access to and use of majidalyousef.com (the "Site") operated by MAJID ALYOUSEF CALLIGRAPHERS AND PAINTERS, trade licence no. 1187332, 2206 Zabeel Tower, Sheikh Zayed Road, Dubai, United Arab Emirates ("we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms, our Privacy Policy, and our Returns & Refunds Policy. If you do not agree, please do not use the Site.

These Terms are governed by, and should be read consistent with, UAE Federal Decree-Law No. 14 of 2023 on Modern Technology-Based Trade, Federal Law No. 15 of 2020 on Consumer Protection, and other applicable UAE federal and local laws.

1. Eligibility

You must be at least 18 years old, or using the Site under the supervision of a parent/legal guardian, to place an order. By ordering, you confirm the information you provide is accurate and current.

2. Products

  • All artworks are original creative works by Majid Alyousef unless clearly described as a print, edition, or collaboration.
  • We make reasonable efforts to display artwork colors, textures, and dimensions accurately; however, actual appearance may vary slightly due to screen settings, lighting, and the handmade nature of the work.
  • Limited-edition prints will state edition size where applicable. We do not guarantee future availability of sold-out or one-of-a-kind pieces.

3. Pricing & Payment

  • All prices are listed in USD and are inclusive/exclusive of applicable UAE VAT as indicated on the product page.
  • We reserve the right to correct pricing errors and to cancel and refund orders placed at an incorrect price before dispatch.
  • Payment is processed securely through PayPal. We do not store your full card details.
  • A digital invoice will be issued for every order, in accordance with UAE e-commerce and tax requirements.

4. Orders & Contract Formation

  • Placing an order constitutes an offer to purchase; a contract is formed only when we confirm acceptance by email/order confirmation.
  • We reserve the right to refuse or cancel any order (e.g., suspected fraud, pricing errors, stock unavailability), with a full refund issued where payment has been taken.

5. Commissions & Custom Work

  • Custom or commissioned artwork is subject to a separate written agreement covering scope, deposit, timeline, revisions, and final approval.
  • Deposits for commissions may be non-refundable once work has commenced, as described in the applicable commission agreement and our Returns & Refunds Policy.

6. Shipping & Delivery

  • We ship via EmiratesPost, Aramex, and DHL, both within the UAE and internationally.
  • Estimated delivery times are provided at checkout and are not guaranteed; delays may occur due to customs, courier, or force majeure events.
  • Risk of loss/damage passes to you upon delivery to the address provided. Please inspect artwork upon arrival and report any damage within 48 hours per our Returns & Refunds Policy.
  • International customers are responsible for any customs duties, import taxes, or fees imposed by the destination country.

7. Returns & Refunds

We do not accept returns or exchanges except where an item arrives damaged or faulty. Full details are set out in our [Returns & Refunds Policy], which forms part of these Terms.

8. Intellectual Property

  • All content on the Site — artwork images, designs, photographs, text, logos, and the underlying artworks themselves — is the intellectual property of MAJID ALYOUSEF CALLIGRAPHERS AND PAINTERS / Majid Alyousef, protected under UAE copyright law and international conventions, unless otherwise stated.
  • Purchasing a physical artwork transfers ownership of that physical item only. It does not transfer copyright, reproduction rights, or licensing rights in the underlying artwork, which remain with the artist unless a separate written licensing agreement is signed.
  • You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

9. User Conduct

You agree not to: - Use the Site for any unlawful purpose or in violation of UAE law - Attempt to interfere with the Site's security or functionality - Submit false or misleading information when ordering - Infringe our intellectual property or that of any third party

10. Limitation of Liability

To the fullest extent permitted by UAE law: - The Site and its content are provided "as is" without warranties of any kind beyond those required by applicable consumer protection law. - Our total liability for any claim arising from your use of the Site or a purchase is limited to the amount you paid for the relevant order. - We are not liable for indirect, incidental, or consequential damages, except where such exclusion is not permitted under UAE Consumer Protection Law.

Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory UAE law, including your statutory consumer rights.

11. Privacy

Our collection and use of your personal data is governed by our [Privacy Policy], which forms part of these Terms and complies with Federal Decree-Law No. 45 of 2021 (PDPL).

12. Complaints & Dispute Resolution

If you have a complaint, please contact us first at majid.alyousef@gmail.com so we can resolve it directly. If unresolved within 30 days, you may escalate the matter to: - The UAE Ministry of Economy and Tourism (consumer protection division), or - The relevant Department of Economic Development in your Emirate

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates. Any disputes not resolved amicably or through the consumer protection authorities shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
